Terms of Service

1. Acceptance

By using TallyRoad, you agree to these Terms. If you do not agree, do not use the service.

2. Description of Service

TallyRoad provides AI-powered traffic counting and turning movement count analysis. You upload video footage, and we process it to produce count reports. TallyRoad is provided "as is" without warranty of accuracy for any specific purpose.

3. Acceptable Use

You may only upload video footage for which you have obtained necessary permissions. Do not upload footage of private property without consent of the property owner. Do not use TallyRoad to conduct mass surveillance, biometric identification, or profiling of individuals. Do not upload footage that depicts illegal activity.

4. Account

You are responsible for maintaining the security of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately at support@tallyroad.co.za if you suspect unauthorised access.

5. Data Retention

Video files you upload are stored on Cloudflare R2 and deleted automatically 30 days after job completion, or immediately when you delete a job. Count results (numerical data only) are retained indefinitely or until you delete them. We do not share your data with third parties except as required by law.

6. Payments and Refunds

All payments are processed by Stripe. Top-up processing hours that have not been consumed may be refunded within 24 hours of purchase. Consumed quota is non-refundable. The free weekly allowance has no monetary value and cannot be refunded.

7. Intellectual Property

Your video footage and count results remain your property. TallyRoad retains rights to the software, algorithms, and service. You grant TallyRoad a limited licence to process your footage for the purpose of providing the service.

8. Limitation of Liability

TallyRoad's liability is limited to the amount you have paid us in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

9. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Disputes are subject to the jurisdiction of South African courts. We comply with the Protection of Personal Information Act (POPIA), Act 4 of 2013.

10. Changes

We will notify you by email at least 14 days before making material changes to these Terms. Continued use after the effective date constitutes acceptance.
